CMARKET LTD. – PROHIBITED ITEMS & SERVICES POLICY

This Prohibited Items & Services Policy (“Policy”) forms an integral part of:
The Master Vendor Agreement
The Customer Terms of Use
All Platform governance documents

In the event of any inconsistency, the stricter provision shall prevail.
This Policy applies to all Vendors, listings, products, services, advertisements, communications, and transactions conducted on or through the Platform.

1. PLATFORM GOVERNANCE PRINCIPLE

1.1 Marketplace Nature
CMarket Ltd. operates as a

digital marketplace intermediary. Access to the Platform is a revocable privilege, not a right.
1.2 Absolute Platform Discretion
CMarket Ltd. retains sole and unfettered discretion to determine whether any item, service, content, or Vendor activity is permitted.
1.3 No Implied Approval
Listing, visibility, or previous acceptance of any item does not constitute approval, certification, or ongoing permission.

2. REGULATED OR RESTRICTED PRODUCTS

The following are prohibited unless expressly pre-approved in writing by CMarket Ltd. and compliant with all applicable Canadian federal, provincial, and municipal laws:
Alcoholic beverages
Cannabis or cannabis-derived products (including CBD)
Tobacco, nicotine, vaping, or e-cigarette products
Prescription medications
Controlled substances
Medical devices subject to Health Canada regulation
Any product requiring federal, provincial, or municipal licensing
Any product restricted, suspended, recalled, or prohibited by law
Vendor bears sole responsibility for verifying legality prior to listing.

3. FOOD & HEALTH RISK PRODUCTS

3.1 Prohibited Food Items include:
Unpasteurized dairy products
Expired, recalled, contaminated, or unsafe food
Food produced in unlawful or non-compliant facilities
Food reasonably suspected of violating health standards
Products making false, misleading, or unverified

medical claims
Food with incomplete or undisclosed allergen information
3.2 Vendor Compliance Obligations
Vendor represents and warrants full compliance with:
British Columbia Food Safety Act
Food Premises Regulation
Public Health Act
Applicable Regional Health Authorities
Home-based food

regulations (if applicable)
3.3 No Platform Inspection
CMarket Ltd.:
Does not inspect kitchens
Does not test food
Does not monitor temperatures
Does not certify compliance
Listing does not equal inspection or approval.

4. COUNTERFEIT & INTELLECTUAL PROPERTY

Strictly prohibited:

Counterfeit goods
Unauthorized replicas
Knockoffs
Pirated digital products
Copyright infringement
Trademark infringement
Patent infringement
Unauthorized use of brand names or logos
Repeated or serious IP violations may result in immediate termination without notice.

5. LISTING

INTEGRITY & MISREPRESENTATION
Vendors may not:
Use misleading imagery
Present stock images as actual product without disclosure
Provide deceptive descriptions
Omit material facts
Engage in bait-and-switch practices
Manipulate pricing visibility

Use fabricated reviews
CMarket Ltd. may remove or edit listings at its discretion.

6. DANGEROUS OR HAZARDOUS GOODS

Prohibited:
Firearms or weapon components
Ammunition
Explosives or fireworks
Hazardous chemicals
Toxic substances
Items posing foreseeable harm to persons or property

Platform determination of “risk” is final.

7. ILLEGAL, HARMFUL, OR SENSITIVE CONTENT

Prohibited:
Pornographic or sexually explicit services
Hate speech or extremist material
Content promoting violence
Human trafficking related

Services facilitating unlawful activity
Wildlife or endangered species products
Any activity violating Canadian criminal law

8. UNLICENSED PROFESSIONAL SERVICES

Services requiring professional licensing are prohibited unless Vendor provides verifiable authorization:

Medical or health services
Legal services
Financial or investment advice
Immigration consulting
Psychological counseling
Insurance brokerage
Real estate brokerage
Vendor bears sole liability for regulatory compliance.

9. FRAUD & HIGH-RISK ACTIVITIES

Prohibited:
Pyramid schemes

MLM recruitment structures
Get-rich-quick schemes
Gambling or betting
Unauthorized crypto solicitation
False scarcity marketing
Payment diversion
Circumvention of Platform fees constitutes material breach.

10. RISK-BASED ENFORCEMENT AUTHORITY

CMarket Ltd. may take immediate enforcement action

where it reasonably suspects:
Legal risk
Regulatory exposure
Fraud indicators
Customer harm risk
Reputational threat
Financial liability exposure
Enforcement may include:
Immediate suspension
Account freeze
Listing removal
Payout withholding
Permanent termination
No prior notice required.
No completed investigation

required.
Good faith risk assessment is sufficient.

11. BURDEN OF PROOF & LIABILITY ALLOCATION

Vendor acknowledges:
Platform decisions are final
Vendor bears burden of proving compliance
Vendor assumes full liability for all listed items
Platform shall not be liable for revenue loss, goodwill loss, or business interruption

12. LEGAL COOPERATION

CMarket Ltd. may: Report suspected unlawful activity
Cooperate with law enforcement
Disclose Vendor information pursuant to lawful requests

13. FUTURE REGULATION CLAUSE

This Policy automatically applies to:
Newly regulated product categories
Legislative amendments
Regulatory reinterpretations
Emerging digital goods
Absence from list does not imply permission.

14. SEVERABILITY & SURVIVAL

If any provision is deemed unenforceable, the remainder remains valid.

Enforcement rights survive termination.
