Food Safety Disclosure


CMARKET LTD. – COMPREHENSIVE FOOD SAFETY & ALLERGEN DISCLOSURE

Effective Date: February 20, 2026
This Disclosure forms part of the Customer Terms of Use and Delivery & Fulfillment Policy.
By placing an order for any food, beverage, or perishable item (“Consumables”), you acknowledge and agree to the following:

1. PLATFORM STATUS & REGULATORY POSITION

1.1 Marketplace Capacity
CMarket Ltd. operates solely as a digital marketplace and technical intermediary.
1.2 Not a Food Premises
CMarket Ltd. is not:
a restaurant
a food premises
a catering business
a manufacturer
a food handler
within the meaning of the BC Public Health Act or Food Premises Regulation.
1.3 No Physical Control
CMarket Ltd. does not:
prepare food
store food
transport food
inspect food
control temperature handling
All such responsibilities belong exclusively to the Vendor.

2. INDEPENDENT VENDOR RESPONSIBILITY

2.1 Regulatory Compliance Representation
Vendors represent that they operate in compliance with applicable BC health regulations, including any required:
permits
food safety plans
sanitation standards
2.2 Health Authority Jurisdiction
Vendors are independently regulated (where applicable) by regional health authorities, including:
Fraser Health

Vancouver Coastal Health
Interior Health
Island Health
Northern Health
2.3 No Platform Inspection or Certification
CMarket Ltd. does not conduct:
on-site inspections
temperature verification
microbiological testing
hazard analysis
Listing on the Platform does not constitute regulatory approval or certification by CMarket Ltd.

3. HOME-BASED & LOW-RISK FOOD BUSINESSES

3.1 Some Vendors may operate under BC home-based food guidelines.
3.2 Where applicable, such operations may not be routinely inspected by a health authority.
3.3 By placing an order, the Customer acknowledges that certain food items may originate from home-based kitchens operating within permitted regulatory frameworks.
3.4 The Customer accepts that regulatory oversight levels may differ between commercial kitchens and permitted home-based operations.

4. ALLERGEN DISCLOSURE & CROSS-CONTAMINATION RISK

4.1 Common Allergens
Consumables may contain or come into contact with:
peanuts
tree nuts
dairy
eggs
soy
wheat/gluten
sesame
shellfish
fish
mustard
sulphites
4.2 Shared Environment Risk
Food may be prepared in environments where allergens are present.
4.3 No Absolute Allergen Guarantee
Neither CMarket Ltd. nor any Vendor guarantees the complete absence of trace allergens.
4.4 Severe Allergy Warning
Customers with severe allergies (including risk of anaphylaxis) must exercise extreme caution and are

solely responsible for:
verifying ingredients directly with the Vendor
determining suitability prior to purchase
4.5 Assumption of Allergy Risk
By ordering, the Customer voluntarily assumes all risks associated with allergen exposure.

5. TEMPERATURE CONTROL & PERISHABILITY

5.1 Vendor Dispatch Responsibility
Vendors are responsible for dispatching food at safe temperatures consistent with general BC food safety standards.
5.2 Transfer of Temperature Responsibility
Upon delivery (as defined in the Delivery & Fulfillment Policy), responsibility for:
refrigeration
reheating
freezing
time control
transfers fully to the Customer.
5.3 Danger Zone Acknowledgment
Food held between approximately 4°C and 60°C for extended periods may pose risk of bacterial growth.
The Customer assumes full responsibility for food safety after delivery completion.

6. RAW OR UNDERCOOKED PRODUCTS

6.1 Consumption of raw or undercooked:
meat
poultry
seafood
shellfish
eggs
may increase the risk of foodborne illness.
6.2 Customers ordering such items do so voluntarily and with knowledge of associated risks.
6.3 CMarket Ltd. shall not be liable for illness resulting from the inherent risks of consuming such items.

7. PACKAGING & ACCEPTANCE

7.1 Customers must inspect packaging upon receipt.
7.2 If packaging appears compromised, damaged, or tampered with:
Customer should document the condition immediately
report via the Platform within the applicable reporting window
7.3 Acceptance of goods without timely report constitutes acceptance of condition as delivered.

8. REPORTING DEADLINES

8.1 Perishable goods: issues must be reported within two (2) hours of delivery.
8.2 Non-perishable goods: within twenty-four (24) hours.
Failure to report within these windows constitutes deemed acceptance.

9. LIMITATION OF LIABILITY

To the maximum extent permitted under the laws of British Columbia:
9.1 CMarket Ltd. shall not be liable for:
foodborne illness
allergic reactions
contamination
improper storage by Customer
vendor preparation errors
9.2 CMarket Ltd. does not exclude liability where prohibited by law, including liability arising from its own gross negligence or statutory non-excludable obligations.
9.3 Any permitted liability shall be limited in accordance with the Customer Terms of Use.

10. DIRECT RECOURSE

Any claims relating to:

food preparation
ingredient composition
sanitation
labeling accuracy
must be directed to the Vendor as the preparer and supplier of the goods.

11. ASSUMPTION OF RISK & ELECTRONIC ACCEPTANCE

By placing an order, the Customer:
confirms they have read this Disclosure
understand the inherent risks of food consumption
voluntarily assume those risks
acknowledge that electronic acceptance constitutes legally binding agreement
